Conditions of Hire

 

 

For the purpose of these conditions, the term HIRER shall mean an individual HIRER or, where the HIRER is an organisation, the authorised representative of that organisation. The term TRUSTEES shall mean the Parochial Church Council. The premises shall mean St John’s Church, Drake Road, Newport.

 

The HIRER is required to ensure that children are protected at all times, by taking all reasonable steps to prevent injury, loss or damage occurring.

 

    The HIRER will, during the period of hiring, be responsible for the supervision of the premises, the fabric and the contents; their care, safety from damage, however slight, and the behaviour of all persons using the premises. The HIRER agrees to accept full responsibility for, and to indemnify the Trustees against all costs, charges and claims, in respect of injury to any person using the Church or present during or in connection with the letting, unless caused by the negligence of the Trustees. The HIRER, and all associated with him/her are to ensure that at all times, the observance of reasonable conduct. No nuisance or annoyance should be caused, to residents in the neighbourhood of the Church. If a hire other than a single-occasion hire involves the presence on the premises of any children or young persons under 18 years of age, the HIRER shall complete a separate form PPP12 to confirm that safe child protection procedures are in place and will be adhered to in accordance with the Home Office document “Safe from Harm”. The prior permission of the trustees must be obtained for the supply of intoxicating liquor or the public performance of music and THE HIRER shall be responsible for applying for and obtaining any necessary licence. The HIRER shall indemnify the Trustees for the cost of the repair of any damage done to any part of the property, including the curtailage, during any period of hiring. Smoking is prohibited in all parts of the premises. The HIRER shall remove  all refuse and waste arising from any period of hire No refuse or waste shall be left on the premises. The HIRER shall not sub-hire the premises. The HIRER shall not use the premises for any unlawful purpose. The HIRER shall comply with all conditions imposed and regulations made in respect of the premises by the Local Authority, Fire Authority, Local Magistrates or others, and shall comply with the terms of any licence granted for public performance of music or dancing. The HIRER must ensure that no more than 150 persons are present on the premises at any time. The HIRER shall ensure that any electrical appliances brought onto the premises carry an up-to-date Portable Appliance Test (PAT) test certificate issued within the previous 12 months The Trustees reserve the right for any Trustee to enter any part of the building during the period of the hiring. The Trustees will take every reasonable care to ensure that the premises and their contents are safe and in good order prior to any period of hire. No items of property shall be left on the premises by any HIRER without the prior consent of the Trustees. Bouncy castles and such items are not permitted. The Trustees may require payment of a deposit in advance of any period of hire and the deposit, or part thereof,may be forfeited in the event of any breach of these terms. The HIRER shall only have the use of the premises for the period of the hiring An additional charge may be made for any over-running. One month’s notice of the cancellation of any hire must be given. If less notice is given, the whole of the fee may be chargeable. On completion of the period of hire, the HIRER shall be responsible for leaving the premises, and surrounds, in a clean and tidy condition. The building shall be satisfactorily locked and secured. All lights, and heating, shall be switched off. Acceptance of any proposed booking is at the discretion of the trustees. The Trustees reserve the right to give church activities priority; they will normally give three month’s notice of any cancellation of a booking that such activities require. The parking of vehicles at the Church is restricted and cannot be guaranteed. A designated fire escape route in the car park must be kept clear of vehicles at all times. Notices and advertising on notice boards of the Church are at the discretion of the Trustees. No notices shall be affixed to any internal or external wall or front doors. Access to the Church is usually arranged via the Churchwardens Acceptance of the booking by the HIRER indicates acceptance of the terms and conditions set out above. All hires require the completion and return of the appropriate hire form, either for One-Off or Regular bookings.
